1. Agreement to Terms

By accessing and using HeartSpark Consultancy's website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Services Description

HeartSpark Consultancy provides:

  • Team building activities and programs
  • Corporate training and workshops
  • Motivational speaking services
  • Public speaking training
  • Organizational development consulting
  • Leadership development programs

3. Booking and Payment Terms

3.1 Booking Process

  • All bookings must be confirmed in writing
  • A deposit may be required to secure your booking
  • Final participant numbers must be confirmed 48 hours before the event

3.2 Payment Terms

  • Payment is due as per the agreed terms in your service agreement
  • We accept bank transfers, M-Pesa, and other agreed payment methods
  • Late payment may result in service suspension or cancellation

4. Cancellation and Refund Policy

4.1 Client Cancellations

  • Cancellations made 14+ days before the event: Full refund minus administrative fee
  • Cancellations made 7-13 days before: 50% refund
  • Cancellations made less than 7 days before: No refund

4.2 Weather and Force Majeure

  • Outdoor activities may be postponed due to weather conditions
  • Alternative indoor activities will be offered when possible
  • Events cancelled due to force majeure will be rescheduled or refunded

5. Participant Safety and Conduct

5.1 Safety Requirements

  • Participants must follow all safety instructions provided by our facilitators
  • Medical conditions that may affect participation must be disclosed
  • Participants engage in activities at their own risk

5.2 Code of Conduct

  • Respectful behavior towards facilitators and other participants is required
  • Discrimination, harassment, or disruptive behavior will not be tolerated
  • We reserve the right to remove participants who violate our code of conduct

6. Liability and Insurance

HeartSpark Consultancy maintains appropriate insurance coverage for our activities. However, participants are encouraged to have their own personal insurance coverage.

  • We are not liable for personal injuries resulting from participant negligence
  • Liability for property damage is limited to the value of the service provided
  • Participants are responsible for their personal belongings

7. Intellectual Property

All content, materials, and methodologies used in our programs are the intellectual property of HeartSpark Consultancy. Unauthorized reproduction or distribution is prohibited.

8. Photography and Media

By participating in our programs, you consent to being photographed or recorded for promotional purposes unless you specifically opt out in writing.

9. Confidentiality

We maintain strict confidentiality regarding client information and expect the same from participants regarding sensitive information shared during programs.

10. Modifications to Services

We reserve the right to modify program content, venues, or facilitators as necessary while maintaining the quality and objectives of the service.

11. Governing Law

These terms are governed by the laws of Kenya. Any disputes will be resolved through the Kenyan legal system.

12. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on our website and take effect immediately upon posting.
